How does condemnation work?

Condemnation is the process by which the federal government exercises its right of eminent domain. The government has the power to condemn property belonging to both businesses and private individuals for public use.

The process begins when the condemner and landowner are unable to reach an agreement on the amount of compensation for the property in question. The condemnor then files a petition with the proper court.

Property condemnation is subject to four restraints:

  • Property must fulfill a public purpose
  • Only the land needed accomplish this public use maybe condemned and no more
  • Adequate compensation must be given to the landowner for their property
  • Practical notice for the condemnation must be given to the landowner and a chance to offer a claim or defense
