Flooded from the Barker or Addicks Reservoir Levee Releases?

We represent homeowners and business owners whose homes or businesses were flooded by the Hurricane Harvey dam and reservoir releases. Hurricane Harvey struck Southeast Texas and brought historic rainfall. The officials and governmental agencies charged with managing local reservoir and dam systems made the conscious decision to flood these homes and businesses. They knowingly released the floodwaters into the homes and businesses of the people they were charged with protecting.

The U.S. Supreme Court has held that the Fifth Amendment is “designed to bar Government from forcing some people alone to bear public burdens which, in all fairness and justice, should be borne by the public as a whole.” Arkansas Fish & Game Commission v. United States, 568 U.S. 23, 31 (2012); see also City of Austin v. GHI Investments, LLC f/k/a GHI Partners, LLC, 03-12-00189-CV (Tex. App. April 30, 2013).
